What if my DACA is expired?

Answer

You can apply for DACA again even if your current DACA is expired for under one year. You may have to show documentation to USCIS to prove that you did not leave the US during the time your DACA was expired.

However, if it has been more than one year since your last grant of DACA expired, that request is considered an initial request and USCIS can accept it, but is prohibited from approving it while the July 16, 2021 court order remains in effect.
