Yesterday, a federal court in Texas temporarily halted the “Keep Families Together” program for undocumented spouses and stepchildren, effective for the next 14 days (or possibly longer). While applications can still be filed, they will not be reviewed by USCIS during this period. We encourage the community to be cautious of any advice stating otherwise and to consult with qualified service providers.

On Jun 18, 2024, the Biden Administration announced a major new immigration initiative to help undocumented spouses and children of U.S. Citizens through a legal step called parole-in-place.
What is Parole-In-Place?
Parole-In-Place allows spouses and children of U.S. citizens to obtain a lawful entry without physically leaving the country. They can then use this lawful entry to apply for their green card through a family petition.
Who may be eligible?
Spouses and children of U.S. Citizens may qualify for PIP if they:
- Are currently in the United States after entering without inspection and have not been paroled
- Have lived in the United States since June 17, 2014 for spouses and June 17, 2024 for stepchildren
- Are legally married to a U.S. citizen or have a qualifying stepchild relationship with a U.S. citizen as of June 17, 2024; and
- Do not have certain criminal history or pose a threat to national security or public safety
What is the benefit?
If you meet the criteria, you MAY be granted parole-in-place, which means:
- Parole would be granted for a one-time period of three years
- You may be eligible for a work permit up to three years
- If granted parole, you may apply for a green card within three years of approval and not have to physically leave the U.S.

How to Prepare:
If you are eligible for Parole in Place, you will need this evidence:
- Government-issued Identity Document (Passport, Consular I.D., etc.)
- Evidence that the qualifying Spouse is a U.S. Citizen (Birth Certificate, Certificate of Naturalization, etc.)
- Evidence of the relationship between the U.S. Citizen and their Spouse/Stepchild (Marriage Certificate, etc.)

Evidence of Continual Physical Presence in the United States since June 17, 2014
- Examples: utility bills, bank statements, money order receipts, auto registrations, postmarked letters, school report cards and transcripts, rent or mortgage receipts, phone or internet records.

The USCIS filing fee for Parole in Place is $580- USCIS will only accept online payment and applications!
- Do not listen to notarios/ immigration consultants/attorneys who offer to file your application via mail or charge you for paper forms!
